Please note that this Release/Waiver Form covers liability of any Fitness/Exercises classes in person or online, or in person or online events held by the owners, and any instructor of n’Caliente Fitness LLC.
I the undersigned, hereby expressly and affirmative state that I wish to participate in the exercise classes. I realize that my participation in this activity involves risks of injury, including but not limited to muscle strain, joint sprains, broken bones, slips, trips, falls, heart attack, stroke, and even the possibility of death. I also recognize that there are many other risks of injury including serious disabling injuries, which may arise due to my participation in this activity, and that it is not possible to specifically list each and every possible injury risk. However, knowing the material risks and appreciating, knowing, and reasonably anticipating that other injuries and even death are a possibility, I hereby expressly assume all of the delineated risks of injury, all other possible risks of injury, and even death, which could occur by reason of my participation. I subjectively understand the risk of my participation in this activity, and knowing and appreciating these risks voluntarily choose to participate, assuming all risks of injury or even death due to my participation.
I do hereby waive, release, and forever discharge n’Caliente Fitness LLC.’s owners, all n’Caliente instructors, contractors, representative, and all others, including the owners, and their properties of any swimming pools we use for Aqua classes, from any and all responsibilities or liability for injuries or damages resulting from any participation in this activity. In person classes or online classes.
I know that by participating in in-person classes I could be at risk of possible exposure to and illness from infectious diseases including but not limited to Covid-19. I hereby waive, release, and forever discharge n’Caliente Fitness LLC’s owners/instructors, and all the venues we are utilizing for the classes.
I hereby authorize n’Caliente Fitness LLC, its contractors, and any third party to publish photographs or videos taken of me while I’m participating at any event or class at n’Caliente Fitness, for use in n’Caliente Fitness’ print, online and marketing materials, as well as other company publications. I release n’Caliente Fitness LLC., its contractors, and any third parties involved in the creation or publication of marketing materials, from liability for any claims by me or any third party in connection with my participation.
Please contact your doctor before starting any new physical activity, and may you receive approval to do so prior to attending class.
